All terms and conditions are governed by the laws of the State of Missouri. In the event of a dispute relating to these terms and conditions, all parties will submit exclusively to the jurisdiction of any court sitting in the State of Missouri and will comply with all requirements of that court.
We are committed to providing objective, unbiased services by consistently producing the most accurate data possible using advanced instrumentation backed by a comprehensive quality assurance system. However, these services are performed without warranty or liability of any kind beyond the amount paid to the laboratory for these services. Trilogy Analytical Laboratory and its employees accept no legal responsibility for our client’s interpretation or use of test results.
Methods, discoveries, procedures, and equipment developed by Trilogy Analytical Laboratory for any specific project shall remain the sole property of Trilogy Analytical Laboratory unless otherwise agreed upon in a signed contract with the client.
Clients are responsible for all costs incurred by Trilogy Analytical Laboratory in complying with any subpoena for documents or any other legal requirements relating to services provided by Trilogy Analytical Laboratory. Our fee for a court appearance, whether there is a requirement to testify or not, is $3,500 per day for each employee, plus expenses.
Trilogy Analytical Laboratory carries worker’s compensation, general liability, and property damage insurance. A certificate of insurance will be provided to the client upon written request. It is not feasible to include our clients as additional insureds on our insurance policies. However, we carry sufficient liability insurance for the type of analytical service we provide.
In the event of default on payment for services rendered, the client is responsible for all reasonable collection and legal fees.
If any of the provisions of these terms and conditions are found to be invalid or unenforceable in any respect, the remaining terms and conditions will be in full effect.
